The ward of court who married mid-lawsuit

Sarah McIntosh

1823–?

The youngest child — whose own wedding, in the middle of the family’s lawsuit, briefly threw the case into chaos.

Married
William Pymble

Sarah, the youngest, was born 21 July 1823 in Sydney and baptised the same day. She married William Pymble — a name already in the family, since her brother Robert had married a Jane Pymble in 1830 — on 25 October 1842, at the Scots Church Presbyterian, Sydney.

That timing mattered more than it might seem. A month earlier, on 20 September 1842, Sarah had been named as one of the plaintiffs in the equity suit her siblings brought against their brother Robert — which made her, as a minor, a ward of the Court. Marrying without the Court’s permission while a case she was party to was still live threw the proceedings into a genuine procedural tangle, one the presiding judge had to untangle before the case could go on.
